| About copyrighted material. | RTFFX and Video Services cannot and will not knowingly reproduce or copy any material for which the client does not own the copyright or cannot otherwise demonstrate in writing that permission from a third party was granted to use the material. A statement in writing that the client is the owner may be required. RTFFX and Video Services make no claims to ownership of client's material unless agreed to in writing. In this context, "client" refers to any customer of RTFFX and Video Services. |
| Privacy Policy |
RTFFX and Video Services will not publicize, use, or otherwise distribute any material used in rendering its services or any generated material as a result unless permission is granted in writing by the author or owner of the material. RTFFX and Video Services normally generates digital data performing its services and will retain the data on-line (meaning available on it computer system(s)) for customer support purposes for a period of at least thirty (30) days after shipping of the results after which time the data will then be purged (deleted). The data will be archived offline before it is deleted, unless the customer requests otherwise. The period of time before the data is archived and deleted,.or just deleted, can be modified (lengthened or shortened) upon request. RTFFX and Video Services reserves the right to refuse to extend this period of time for any reason whatsoever. (Normally the reason for such a refusal would be due to a shortage of available resources [e.g. disk space] and no further requests for related services are expected in the near future) RTFFX will also not release customer information without permission to third parties except as required by law. RTFFX asks customers only for enough information to do business (e.g. for their "mailing address" or "phone number"). For the "login" side of this website [Note: this is not yet functional. This is coming soon!], the only information required to register and to create a "guest" user login account is the user's name and a valid email address. |
| Credit for value added | For advertising purposes, RTFFX and Video Services may place its DVD authoring logo on DVD media containers (example: DVD cases) supplied to customers, in an unobtrusive location. The logo merely identifies who did the work. Occasionally RTFFX may also wish to place a logo on the media itself. Typically the customer is asked about this first. On DVDs the logo would be accessed from a separate menu "button" and not automatically played after the video or within any other defined sequence. An animated logo example can be found on the "animated demo page". Usually the button placed on a menu will use the text: "Authored by:". On other media such as tape, typically a slide will appear at the end of the video. |
| Other Licensing | RTFFX may create animations or other unique work-product not directly based on images or other material supplied by a client of RTFFX. RTFFX retains ownership of the means or method of creation of such material, but grants unlimited viewing rights of this material to the client, or others permitted to view the material by the client. Such content may be reproduced only with the entire work which contains it and only for non-commercial use. RTFFX reserves the right to offer and include identical or similar material in other work output supplied to other of its clients unless another arrangement was previously agreed to in writing. In this context, "client" refers to any customer of RTFFX and Video Services. |
| Guarantee | RTFFX wants to have satisfied customers. RTFFX provides a two part guarantee. 1) RTFFX and Video Services will issue a full refund to you at any time while an order is in process, but not yet started. In order to continue to provide low cost services, however, RTFFX and Video Services will be unable to issue any refunds once work has been started on an order, unless when completed the shipped product is shown to be defective and/or unuseable and you do not wish to receive a replacement. For DVD or editing orders, start of work means the initial digitization of the video. For videotaping services, this means anytime after five (5) business days before the event. For slideshows, it means receipt of the slides or photos. In the case of product defect(s), to exercise the guarantee, you must return the defective product. 2) RTFFX and Video Services will correct any errors that exist in the final results if notice of the error or errors is received within 30 days after the final results are delivered. The customer also must return the media containing the results to RTFFX in order for the error(s) to be corrected. The error(s) will be corrected as soon as possible and corrected results on similar media will be provided at no charge. This part of the guarantee covers issues that any reasonable person would identify as objectively incorrect and not disagreements which are subjective and/or matters of taste or opinion. In the very unlikely event that an uncorrectable error was made, in addition to fixing any other correctable errors, a partial or full refund will be offered. The media and any copies must be returned to RTFFX in order to get a full refund. RTFFX's liability is limited to a full refund of monies paid to engage its services. RTFFX cannot be held responsible in the event issues arise as a result of a problem or problems playing a disc authored by RTFFX on a specific DVD player or players, where the disc is known to work on other players, However, RTFFX, will treat this scenario as any other product support issue (see above). RTFFX may attempt to make programming changes to the DVD as a work-around to the problem(s), assuming such a work-around is possible.
Liability on projects with mandatory deadlines is limited to a full refund (RTFFX keeps the work product) or a refund of half of the quoted price (customer keeps the work product). The deadline must have been made known prior to the issuance of the quote and must be specified as part of the quote. (It is the responsibility of both parties to ensure that if a mandatory deadline is requested, it is included as part of the quote.) |
